Registered sex offenders who have committed sex offences against children between 2014-2017

Question

I am sending you this request under the Freedom of Information act concerning child sex offenders investigated by your force.

1) Please state the number of child sex offenders that were

a) Investigated

b) Cautioned

c) Charged

By your force in each of the following calendar years

i) 2014

ii) 2015

iii) 2016

iv) 2017 to March 1st

2) For each case involving an investigation, caution or charge covered by question 1, for the time period 2014 – 1st March 2017, please state: 

a) The offence committed or alleged to have been committed

b) The age of the offender at the commencement of the case

The outcome of the case (E.g., no further action, caution, acquittal at trial, prosecution). If a prosecution resulted, please state the sentence laid down.

You clarified on the 30th March:

This request relates to anyone who has committed a sex offence against a child under the age of 18.

Answer

We have extracted crimes with a victim of under 18 that were committed by a person with a marker of ‘Registered Sex Offender’.

With regards to question 2 it was my intention to provide this information, however having reviewed the information, it is very detailed and I feel the details of the offences together with the specific result and the age, broken down by year would allow individuals to be identified. Therefore the exemption applicable to this is Section 40(2), third party personal information. This is an Absolute exemption so therefore there is no requirement to conduct a harm or public interest test. Any information is exempt from disclosure under the Freedom of Information Act if it relates to or is supplied by another individual and disclosure of that information would contravene any of the principles of the 1998 Data Protection Act, in this particular case, disclosure of this information would contravene Principles 1 and 2 of the Act, whereby personal data shall be processed fairly and lawfully and only obtained for one or more specified purpose or purposes.
