Crimes Committed By Children Under 10 in 2016

Question

During the calendar years 2014, 2015 and 2016 up to 23rd December  (each year broken down)

How many offences were committed where the alleged offender was under the age of 10?

Can you please specify the alleged offence?

Would it be possible to give the age of the individual accused of perpetrating the offence?

If you've already recently answered this question in a previous FOI - can you please direct me to your disclosure log?

Answer

Your request for information has now been considered and I am not obliged to supply the information you have requested for the years 2014  and 2015.

The exemption applicable to this information is Section 21 – Information reasonably accessible by other means. This is an absolute and class based exemption and as such does not require a harm and public interest test.

The information requested is publicly available to view on our Freedom of Information pages under Previous FOI Requests. I have provided specific links for reference.

In accordance with the Act, this represents a Refusal Notice for this part of your request.

Please find the requested information for 2016 in the table below:

Children under the age of ten are not considered to have reached an age where they can be held responsible for their crimes. Because they are under the age of 'criminal responsibility' they cannot be charged with any criminal offence. No child under the age of ten shall be guilty of a crime; however they can still commit an offence which will be recorded. Please find details below concerning instances were a child under 10 has been believed to be responsible for or suspected of an offence.
