1. The number of incidents logged in which so-called ‘legal highs’ (now known as ‘New Psychoactive Substances’) were mentioned in the financial years 2015/16, 2014/2015 and 2013/2014.
2. A breakdown of incidents in which any of the above terms appeared in the 2015/16 financial year. I would like to receive the information in a spreadsheet split into the following columns:
Date, Location, Description of incident, Legal high term mentioned, Type of offence recorded (if applicable)
Please find the information in the table attached.
I have provided you with the month, area and incident type as opposed to description, as the full details would have allowed individuals to be identified, and as such is exempt from disclosure.
The exemption applicable to this is Section 40(2), third party personal information. This is an Absolute exemption so therefore there is no requirement to conduct a harm or public interest test. Any information is exempt from disclosure under the Freedom of Information Act if it relates to or is supplied by another individual and disclosure of that information would contravene any of the principles of the 1998 Data Protection Act, in this particular case, disclosure of this information would contravene Principles 1 and 2 of the Act, whereby personal data shall be processed fairly and lawfully and only obtained for one or more specified purpose or purposes.
In all cases the term ‘Legal high’ was mentioned.
