Detentions In Custody Under Section 136 - Mental Health Act

Question

How many times each year in the past three years have police cells been used as a place of safety under the Mental Health Act?

And can you tell me how many were juveniles (i.e. under 18) and adults, and how many were male and female?

Please could you supply figures for 2015, 2014 and 2013?

For the juveniles, please could you tell me their age, sex and length of time detained?

Answer

Please see the table below for the total number of detentions in custody under section 136 of the Mental Health Act.

Please note, this does not include persons in this age group, who have been detained by police and taken straight to suitable accommodation provided by the Primary Health Care Authorities.

From May 11th 2015 the Constabulary introduced a protocol that it would no longer accept under 18’s detained under section 136 MHA into police custody. Since that date we have been working closely with our partners in the health service to ensure that children detained under the Act receive the appropriate care in a health based place of safety, we have consequently not had to use police cells for such a purpose since then.
